The real facts regarding the use of conservation easements on your property

  • You select the land that you would like to place in an easement; you do not have to place all of your land in the easement
  • You will earn a Federal tax deduction equal to a 50% reduction of your adjusted gross income with a carry forward of fifteen years (100% deduction for farm-based revenue)
  • You will be able to pass your land to your heirs at a reduced estate tax value
  • You can sell your land to another person and the easement will pass to them, but you will keep the deduction
  • When you place a conservation easement on your land, you only give up certain development rights;  you can do everything on your land after you place an easement as you did before the easement was placed
